WV Hospital Plans and Legislative Rules Instructions
Effective 1/1/2026, hospitals are required through Legislative Rule §149-11 (Sexual Assault Forensic Examinations) to have a qualified healthcare provider performing medical forensic services available 24 hours a day, seven days a week. 
The following documents cover more about the Legislative Rule, how "Qualified Healthcare Provider" is defined, acceptable coverage options for qualified healthcare providers, and the responsibilities of WV Hospitals providing sexual assault medical forensic examinations.
   
WV Hospital Plan for Treatment/Transfer of Patients Reporting Sexual Assault
All hospitals must complete either a treatment or transfer plan for both Adult/Adolescent and Pedicatric/Adolescent populations. Hospitals should use the documents provided to ensure they are meeting all sections of Legislative Rule §149-11. The hospital must place any plan notes and reference any documents they are attaching in the Hospital Plan Notes column (for example: policies or procedures, educational handouts for victims) that meet each section as required. Once the facility has completed the combined Treatment-Transfer plan document AND the Legislative Rule with Standards document, save the files with the format of "HospitalNameDate" and submit a completed signed plan along with any required attachments to:
